NEW DELHI: The Directorate of Revenue Intelligence (DRI) has accused Oppo India of duty evasion of around Rs 4,400 crore, following searches that were carried out at the offices of the Chinese telecom company’s Indian arm as well as the residences of some key employees.

The searches led to the recovery of documents that pointed to alleged “wilful mis-declaration” in the description of certain items imported by Oppo India for manufacturing mobile phones.

“This mis-declaration resulted in wrongful availment of ineligible duty exemption benefits by Oppo India amounting to Rs 2,981 crore. Among others, senior management employees and domestic suppliers of Oppo India were questioned, who in their voluntary statements accepted the submission of wrongful description before the customs authorities at the time of import,” an official statement said.

The company was also accused of remitting or making provisions for payment of ‘royalty’ and ‘licence fee’ to various multinationals, including those based in China, for using their proprietary technology, brand or IPR licence. This was not being added to the transaction value of the imported goods, which resulted in an alleged duty evasion of Rs 1,408 crore.

When contacted, an Oppo India spokesperson said, “We have a different view on the charges mentioned in the show-cause notice (SCN). We believe it's an industry-wide issue many corporates are working on. Oppo India is reviewing the SCN received from DRI, and we are going to reply to the notice, presenting our side, and will be working further with the related government departments. Oppo India is a responsible corporate and believes in prudent corporate governance framework. Oppo India will take appropriate steps as may be needed in this regard, including any remedies provided under the law.”

The statement by the government said a sum of Rs 450 crore has been voluntarily deposited by Oppo India, as partial differential customs duty short paid by them.

The official statement also said that through a showcause notice last week, the handset manufacturer has been asked to pay Rs 4,389 crore as customs duty apart from penalties on the company, employees as well as Oppo China, which is the parent company.

In recent weeks, Chinese telecom players, ranging from Huawei to iaomi, Vivo and One Plus have been facing multiple actions by the I-T department, ED and customs authorities. The probes come after the government decided to keep close tabs on Chinese companies, including restricting their access to Indian markets, following the tension in Ladakh.

As per WTO treaty India cannot directly ban Chinese products. But Atleast we can encourage our citizens to not to purchase Chinese product and give way to manufacture Indian made products. The large chunk of earning they get from selling mobile phone which capture almost 80%. If we are purchasing appo, Vivo, realme, one plus, IQOO, immo phones, that itself mean we are hel them to use our money against us. So first we have to change and instead of purchasing these brand phone etc we should demand Indian made and encourage India brand like Lava etc..

根据世贸组织的条约，印度不能直接禁止中国产品。但至少我们可以鼓励公民不买中国货，选择印度制造。
