Supreme Court reverses own 2018 ruling on automatic vacation of stays

NEW DELHI: A five-judge Supreme Court bench on Thursday reversed a three-judge bench's 2018 verdict mandating automatic vacation of high court-ordered stays on proceedings in civil and criminal cases after six months if the interim order was not reiterated within that span.

In a unanimous decision, a bench of Chief Justice D Y Chandrachud and Justices Abhay S Oka, J B Pardiwala, Pankaj Mithal and Manoj Misra said HCs were not subordinate to SC and that the apex court could not exercise its omnibus power under Article 142 to fix time schedule for disposal of cases, which were diverse in nature. The 2018 judgment was given in the Asian Resurfacing case by Justices A K Goel, R F Nariman and Navin Sinha.

The whole Judiciary in from top to bottom is a farce, treachery, west of taxpayers money. Rich people can manipulate, delay the justice for undefined time by rampant and unchecked corruption at lower courts. At the HC and SC level the the manipulation and corruption is systematic through highly paid SC Dallas so called Senior Lawyers. Can a common citizen guess how much Legal Fee a Sr Lawyer charges per hour, it is mind boggling amount running in lakhs per hour sometimes it is in minutes to stand in SC courts. How come no judge at lower or higher court hardly investigated by CBI and ED and sent to jail. Until and unless this Judiciary is not revamped with a responsible and transparent system, we can’t call ourselves developed.

As it is matters are pending in all Courts for decades without any accountability on part of Courts. Such allowance of indefinite stay means further chaos. Can our Justice system outsourced from efficient Countries like Singapore and Hongkong for speedy service?

what nonsense verdict !! it means that the High and mighty will bribe the HC and get longer stays. can the poor afford to do it. bribery doesn't mean monetize incentive but plum posting and women like in case of ex-cji. even after 6 months it is the duty of the High Court to at least give a hearing to the poor before automatic reversal of stay order kicks in.

Only Advocates and judges are very happy with this judgement not the general public where the court's are supposed to serve . Advocates now got opportunity to make good amount and judges are relieved with the work and enjoy winter and summer holidays . If the supreme court judges are concerned about providing justice then, why can't the supreme court remove this summer and winter vacations to the courts. SC is amending the laws and rules for their personal comfort and choice.
